Nicholas County WVDCR Photo Policy
WVDCR Policy Directive 151.00 gives the strongest documented description of the booking-photo process. At booking, WVDCR takes a front view and left and right profile views. The policy uses the front image on the Offender Information System header. WVDCR also uses one OID across prior adult incarcerations, which helps connect a photo request to the correct person and custody episode.
A public jail result may include that image alongside identity, institution, and booking or case data. Availability can change when the record falls outside the current search, the interface changes, or a lawful restriction applies. A photo is not a release marker. The live RJA disclaimer warns that data can change fast and may not reflect true location, release date, or status. Pair the image with the WVDCR release event and the Nicholas County court record when the later outcome matters.

Nicholas County Sheriff Photo Limits
No official Nicholas County recent-release gallery or sheriff mobile app was verified. Therefore, the statute does not require WVDCR to remove the OIS header image, does not make all booking photographs confidential, and does not command every publisher to erase a copy. No separate West Virginia commercial anti-pay-to-remove statute was found in the official code sweep. That is a limited research finding, not a conclusion about every possible claim.
Nicholas County Mugshots After Expungement
Nicholas Circuit Court is the local forum for a petition concerning a Nicholas County conviction. Under West Virginia Code §61-11-26, an otherwise eligible single misdemeanor generally has a one-year waiting period, multiple misdemeanors two years, and an eligible nonviolent felony five years. Local and statewide news may retain an agency-supplied arrest image after the current WVDCR record changes. Such a report can help establish when the arrest became public and which agency supplied the image. It does not prove the later release. Commercial mugshot publishers and data aggregators present greater risks. Their records may be stale, misidentified, stripped of later court context, or paired with a demand for payment.
